We are an indigenous people, Ashaninka, from the Amazon region Alto Juruá in state Acre, Brazil. This petition refers to the lawsuit concerning the illegal logging activities in our territory. The defendants have been tried and convicted in 2009 – but since than the case has been halted and still awaits the last final trial at the Federal Supreme Court (FSC). Our Ashaninka community is therefore asking the Minister President JOAQUIM BARBOSA of the FSC to handle our case as a priority and to vote on the URGENT SPECIAL APPEAL No. 654833.

Why your support and signing of the petition is important

We, the indigenous Ashaninka people from the Apiwtxa village, living in our indigenous territory Kampa of the Ammonia River which is located in the municipality of Marechal Thaumaturgo in state Acre, Brazil, urgently request judgment in the Public Civil Action lawsuit filed against the illegal loggers in our territory.

The process refers to the indemnities and reparations for moral and material damages arising from harmful practices, abuse and environmental damage directly involving our Indigenous Peoples Territory( IT) Kampa River Ammonia as well as indirectly throughout the Upper Juruá and the State of Acre.

We remind everyone that this situation has been discussed, documented and filed since the mid-90s.

In 2008 the juridical process was reopened, and after several hearings in Acre the defendants cited in the case were sentenced to pay the indemnities due and reparation of the degraded territory.

The lawyers representing Mr. Orleir Messiah Cameli and the other (illegal loggers) tried every judicial possibilities to get a get a ban of the judgment and condemnation, but they failed and lost in every and each instance.

Our Public Civil Action lawsuit above described is since then on a halt at the FEDERAL SUPREME COURT in Brasilia, waiting for evaluation and judgment by ministers since August (ie, it’s been over a year in this condition).

The Community Apiwtxa (Ashaninka) dares the limitations that we face to achieve the regulation of the crimes that have been committed by the defendants (Orleir Messiah Cameli and others), and we are worried by the possibility of an acquittal of their crimes, which would be a monumental defeat for the environmental cause (on a national and global level), as well as a proof of disrespect for indigenous peoples, the population and the Brazilian state, and finally – a proof of incapacity and inefficiency of the juridical justice system.

We wish to remind that the illegal acts and violations began in the early ’80s and continued until the early 90s, when our community started to take legal Civil Actions measures to combat the atrocities and violence that we were facing under the command of the defendants cited here.

For all these reasons, our community is asking the HONORABLE. SR. MINISTER PRESIDENT of the Supreme Court Joaquim Barbosa to consider our case as a priority and to vote on the URGENT SPECIAL APPEAL No. 654833.
